AI Governance Is Moving From Guidance to Law

The EU AI Act is entering a major implementation phase, and it is another clear sign that AI governance is moving from voluntary guidance into enforceable regulation.
The Act is not just aimed at stopping harmful AI use. It creates a broader framework around how AI is developed, deployed, documented and monitored.
Key areas include transparency, copyright, safety and security, general-purpose AI models, high-risk AI systems, and the labelling of AI-generated content. Providers of general-purpose AI models are already subject to obligations, with the European Commission’s enforcement powers commencing from 2 August 2026.
This matters beyond Europe.
The EU has often set the tone for global digital regulation. The GDPR is the obvious example. Once major markets start legislating AI governance, businesses everywhere should expect similar expectations to flow through supply chains, contracts, customer requirements and local regulation.
Australia is already moving in the same direction.
The Australian Government has recently announced Australian Standards for AI, an Office of AI, and whole-of-government AI safety priorities covering privacy, workplace safety, consumer protection, automated decision-making and digital duty of care.
The message is becoming clearer: AI governance will not stay optional forever.
For Australian businesses, now is the time to understand where AI is being used, what data is being entered, who is accountable, what risks exist, and what controls are in place.
Good AI governance does not need to be overly complicated. It needs to be practical, documented and proportionate to the way the business actually uses AI.
